The petitioner seeks pre-arrest bail in connection with Sikty P.S. Case No. 21 of 2007 for the offences alleged under Sections 498A, 323 and 379 of the Indian Penal Code. The accusation is of torturing of informant/complainant for not fulfilling the demand of cash of Rs.25,000/- by her husband and in-laws and later on performing re-marriage of her husband and removing her from matrimonial house snatching her personal belongings causing assault by her husband and in-laws.

The submission of the learned counsel for the petitioner is that petitioner is the second wife of the husband of the informant/complainant and she has falsely been implicated in this case with ulterior motive.

Patna High Court CR. MISC. No.57604 of 2019(2) dt.11-09-2019 2/2 Learned Additional Public Prosecutor for the State opposes the prayer for pre-arrest bail.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Sikty P.S. Case No. 21 of 2007 shall be released on pre-arrest bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Subdivisional Judicial Magistrate, Araria, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
