State of Bihar and Ors. reported in AIR 2001 Patna 115 and the subsequent Hon'ble Division Bench Judgment of this Court passed in Civil Review No. 467 of 2018 in the case of M/S Usha International Ltd. Vs. The Commissioner of Commercial Taxes, Bihar & Ors. reported in 2019 (1) PLJR 872.

The interlocutory application seeking the condonation of delay of three years ten months and nine days does not contain any cogent much less sufficient reason to condone this delay.

Keeping in view that the review petitioners were the parties to the First Appeal as appellants and learned counsel appearing on their behalf made a statement that despite all his endeavours and all his communications made to the appellants, he was not getting any instruction, this Court finds no merit in this application.

4. The application seeking condonation of delay is dismissed.

5. In view of the dismissal of the application seeking condonation of delay, the Civil Review Application would not proceed.
