The petitioner is languishing in custody since 23.07.2019 in a case for the offence registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016 and 2(e), 3/5 (b), 18 and 42 of Mahuaphul Niyamawali.
The prosecution story, in brief, is that total 50 Quintal Mahua Flower is said to have been recovered.
It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. It is alleged that total 50 Quintal Mahua Flower is recovered. There is no compliance of Section 100 of
Patna High Court CR. MISC. No.56855 of 2019(2) dt.09-09-2019 2/2 Cr. P.C.
On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R./complaint case.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, (Excise),Gaya, in connection with Belaganj P.S. Case No. 166 of 2019.
