This is a regular bail matter. The appellant was refused regular bail by the learned Special Judge under the provisions of SC/ST (Prevention of Atrocities) Act, hence this appeal is under Section 14(A)(2) of the said Act. The appellant is accused in connection with Darbhanga Sadar (Mabbi O.P.) P.S. Case No. 219 of 2016 registered under sections 302 and 34 of the Indian Penal Code, Section 27 of the Arms Act and Section 3(2)(v) of the SC/ST (Prevention of Atrocities) Act.
The appellant is not named in the F.I.R and the F.I.R. would reveal that the allegation of commission of murder
Patna High Court CR. APP (SJ) No.1493 of 2017 (2) dt.31-05-2017 2/2 of the son of the informant is against other named persons. Only material against the appellant is confession of the appellant before the police during the investigation of the case. Considering the facts aforesaid, let the appellant, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judgecum-Special Judge (SC/ST POCSO Act), in connection with Sessions Trial No. 479 of 2016 arising out of Darbhanga Sadar (Mabbi O.P.) P.S. Case No. 219 of 2016.
This appeal stands allowed accordingly.
