Earlier, the bail petitioner of petitioner was rejected, vide order dated 29.06.2021 passed in Cr.Misc. No. 13783 of 2021 (Annexure-1).

It is submitted on behalf of the petitioner that in this case, uptillnow, the informant and three witnesses have already been examined and none of them supported the prosecution case and have been declared hostile. Petitioner is in custody since 21.08.2020.

Learned A.P.P. for the State has opposed the bail petition.

Considering the period of custody and the fact that the witnesses, who have been examined, have not supported the

Patna High Court CR. MISC. No.71842 of 2021(3) dt.09-02-2022 2/2 prosecution case, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge XVI, Gaya / concerned court in connection with S.Tr.No. 46 of 2021, arising out of Khizarsarai P.S. Case No. 26 of 2020.
