Petitioners seek bail in a case registered for the offences punishable under Sections 272/273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2016.
The petitioners are in custody since 03.03.2017. Allegation is that from the pickup van, of which the petitioners were driver and cleaner, huge quantity of liquor was recovered. The petitioners have stated on oath that they have got no criminal antecedent.
Considering the fact aforesaid and the period already undergone by the petitioners, let the petitioners, above
Patna High Court Cr.Misc. No.22044 of 2017 (3) dt.20-06-2017 2/2 named, be released on bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Sherghati, Gaya/successor Court in connection with Amas Police Station Case No. 43 of 2017, subject to the condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners with further condition that the petitioners shall file undertaking before the court below that they would not involve in such activity in future and if the court below would come to the knowledge that the petitioners have violated the aforesaid law, it shall be a ground for cancellation of bail of the petitioners by the learned court below.
