The petitioner seeks bail in Belaganj P.S. Case No. 88 of 2017 instituted for the offence under Section(s) 7 of the Essential Commodities Act.

The petitioner is driver of the truck.

It has been submitted that the petitioner was only carrying the bags of rice and there is no complaint that rice loaded on the truck belongs to the P.D.S. shop and he has been made accused merely on suspicion.

As per the written report, Police apprehended 377 quintals Arwa rice loaded on a truck. The informant has alleged that aforesaid rice of P.D.S. was being transported after changing the bags. But there is no complaint that rice loaded on a truck belonged to P.D.S.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of like amount each to the satisfaction of the Additional Chief Judicial Magistrate-XI, Gaya in connection with Belaganj P.S. Case No. 88 of 2017, subject to the condition that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) Mahesh/- U T
