The petitioner seeks bail in connection with Azam Nagar (Salmari O.P) P.S. Case No. 94 of 2017, registered under Section 30(a) of Bihar Prohibition and Excise Act, 2016. The accusation is that in course of patrolling duty, petitioner was seen at about 6.30 P.M. at Mukuriya railway station and on seeing the Police petitioner started fleeing, but he was apprehended and 60 liters of mixed country made liquor and toddy was recovered kept in a plastic gallon. Learned counsel for the petitioner submits that, in fact, petitioner, who was present at the railway station was apprehended by the Police mere on suspicion, while the real
Patna High Court Cr.Misc. No.23716 of 2017 (2) dt.28-06-2017 2/2 culprit succeeded to flee away. Further submission is that petitioner having no criminal antecedent is in custody since 02.03.2017.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar in connection with Azam Nagar (Salmari O.P) P.S. Case No. 94 of 2017. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
