The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 392 of the Indian Penal Code.

As per prosecution case, while the informant was going to his house after performing his work, in the meantime, three miscreants riding on a motorcycle came near and on the point of gun, snatched a bag containing Rs. 1,25,000/- and other articles from the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Neither the petitioner named in FIR nor any recovery of looted articles has been made

Patna High Court CR. MISC. No.59201 of 2022(3) dt.07-02-2023 2/2 from the possession of the petitioner which connect his complicity in this case. The name of the petitioner came into light on the basis of confessional statement of co-accused Ranjay Singh @Budha Singh. It is further submitted that the petitioner has not been put on TI Parade till date. The petitioner is languishing in judicial custody since 28.6.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Nawangar P.S. Case No. 191 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar.
