JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-06-2017 The petitioner seeks regular bail in connection with Ara Nawada P.S. Case No. 598/16, registered for offences punishable under Sections 324, 307, 379/34 of Indian Penal Code and Section 27 of Arms Act.

Allegation against the petitioner is of firing causing gunshot injury to one Deepak Yadav.

It has been submitted on behalf of the petitioner that as a matter of fact a scuffle took place between the parties, in which both sides have received injuries and it is alleged that one Deepak Yadav received injury, however, the same is found to be simple in nature, which is evident from injury report, which is annexed with this petition as annexure -3, whereas the injury received by the petitioner in the said scuffle was found to be grievous in nature,

Patna High Court Cr.Misc. No.21893 of 2017 (3) dt.19-06-2017 2/3 which will appear from paragraph -31 of the case diary. Petitioner has no criminal antecedent .

Learned counsel for the State could not controvert the above submissions of learned counsel for the petitioner. Having heard both sides, in view of the facts and circumstances of the case, nature of injury received by the injured and also petitioner has himself received grievous injury and now he has remained in judicial custody for more than three and half months and has no criminal antecedent, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate Ara, in connection with Ara Nawada P.S. Case No. 598/16, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and
