This is the second attempt of the petitioner to approach before this Court for bail. Earlier, vide detailed order dated 18.08.2021 passed in Cr. Misc. No. 24395 of 2021, the prayer for bail of the petitioner was rejected with a direction to the learned Court below to expedite the trial.

Vide order dated 09.11.2022, a report was called for from the learned Court below regarding the stage of the trial and the time likely to be taken in conclusion of the trial. In compliance thereof, a report dated 06.12.2022 has been sent by the learned Judicial Magistrate 1st Class, Uda-Kishunganj at Madhepura. In his report, the learned Judge has, inter alia,

Patna High Court CR. MISC. No.59204 of 2022(4) dt.04-01-2023 2/2 stated that the trial will be concluded within six to eight months. Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. The prayer for bail is hereby once again rejected.

The learned court below is directed to conclude the trial within six months and both parties are directed to cooperate in trial.

If trial is not concluded within eight months, the petitioner is at liberty to renew his prayer for bail. (Anjani Kumar Sharan, J) ajay/- U T
