The petitioner seeks bail in connection with G.R.P./Darbhanga/Sitamadhi Rail P.S. Case No.85 of 2016 registered under Section 370 of the Indian Penal Code besides Section 16 of the Bounded Labour System Abolition Act, 1976. The accusation is that on receiving secret information about carrying the children to Bombay on Karmbhumi Express on boarding at Railway Station-Bairganiya (Sitamarhi), the informant alongwith other officials reached at Railway Station-Bairganiya (Sitamarhi) where 10 persons including the petitioner were

Patna High Court Cr.Misc. No.20085 of 2017 (2) dt.12-05-2017 2/2 apprehended alongiwth 28 children.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that one child, namely, Bablu Kumar, was found with the petitioner. In fact, Bablu Kumar is the nephew of the petitioner but under misconception, the petitioner has falsely been implicated in this case. The petitioner is in custody since 22.10.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Rail, Samastipur, in connection with G.R.P. [Darbhanga] [Sitamadhi] P.S. Case No.85 of 2016.
