Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 353, 307, 504 of the Indian Penal Code and Sections 25(1-b)a, 26, 27, 35 of the Arms Act.
According to FIR, from the house of co-accused Ramanand Yadav, a group of criminals started firing on the police party, the informant of this case. However, the miscreants were intercepted which includes the petitioner. From possession of the petitioner, a loaded country made pistol was recovered along with four live cartridges.
The petitioner has stated his criminal antecedents in paragraph no. 3 of the bail petition. Petitioner is in custody
Patna High Court Cr.Misc. No.24130 of 2017 (3) dt.28-06-2017 2/2 since 19.11.2016.
Considering the entire facts aforesaid, let the petitioner, above named, be released on bail, on completion of one year of custody if the trial is not concluded in the meantime, on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Saharsa/successor Court in connection with S.T. No. 19 of 2017 arising out of Salkhua (Chiraiya O.P.) Police Station Case No. 225 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
