The petitioner is accused in connection with Bounsi P.S. Case No. 53 of 2015, registered under Section 304(B) and 201/34 of the Indian Penal Code.

The accusation is of killing of Chandani Devi, daughter of the informant by her husband and other in-laws of the family due to non-fulfillment of demand of dowry and throwing the dead body in the well.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is husband of the deceased and he has been falsely implicated in this case mere on suspicion. Further submission is that, in fact, deceased Chandani Devi, wife of petitioner had gone to attain call of nature, in the evening, and

Thereafter, the dead body recovered from the well and information was given to the informant, father of the deceased, Jhaksu Mohli. Subsequently, the Post-mortem of dead body was done. Further submission is that in the Post-mortem cause of death is Asphyxia due to drowning and one lacerated wound found at the upper eyebrow, which caused due to fallen in the well.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Banka in connection with Bounsi P.S.
