The petitioner seeks regular bail in connection with Manpur P.S. Case No. 39 of 2017, registered for offences punishable under Sections 467, 468 and 420 of Indian Penal Code. Prosecution story is that police on confidential information that villagers have caught hold the petitioner on the allegation that he was cheating the villagers on the pretext of providing them employment, reached at the spot and apprehended the petitioner, from whose possession, four applications and one notebook were recovered.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and no allegation against

No.24705 of 2017 (2) dt.30-05-2017 2/2 the petitioner under above mentioned Sections of Indian Penal Code is made out as there was no recovery from the possession of the petitioner, suggesting petitioner has cheated anyone. Further petitioner has no criminal antecedent and has been languishing in judicial custody since 22.03.2017.

Having heard both sides, considering the facts and circumstances of the case, nature of allegation, period of custody and also that petitioner has no criminal antecedent, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-III, Nalanda at Biharsharif, in connection with Manpur P.S. Case No. 39 of 2017.
