JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-09-2019 This application, for grant of anticipatory bail, arises out of Mohammadpur P.S. Case No. 105 of 2019, disclosing offences under Sections 341, 323, 307, 324, 504/34 of the Indian Penal Code.

Prosecution case is that while the informant along with his nephew were going to marked, the accused persons including petitioner came and stopped them and co-accused Manish Rishi inflicted knife blow causing injury in the right hand, left hand and on neck of the informant. Co-accused Kamal Kumar assaulted his nephew and petitioner also alleged to have assaulted informant.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and no specific role has been assigned to the petitioner rather only general and

No.56608 of 2019(2) dt.06-09-2019 2/2 omnibus allegation has been levelled against the petitioner and one of the injuries sustained by the informant was found grievous in nature but that has not been attributed to the petitioner. Further submission is that similarly situated co -accused has already been granted the privilege of anticipatory bail by a coordinate Bench of this Court vide order dated 14.08.2019 passed in Cr. Misc. No. 50541 of 2019. Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -I, Gopalganj, in connection with Mohammadpur P.S. Case No. 105 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
