Prayer in this application is for grant of bail to the petitioner who is accused of Complaint Case No. 1091 (C) of 2015 registered under Section 420 IPC.
Considering the fact that the petitioner is not the purchaser under the sale deed (Annexure-2) and that cheque which allegedly got dishonoured was not issued by her but by her husband, who is also facing prosecution, as also the fact that she has remained in custody for more than one month, it is directed
Patna High Court Cr.Misc. No.23871 of 2017 (2) dt.25-05-2017 2/2 that the petitioner abovenamed be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri Ranjeet Prasad, J.M. Ist Class, Danapur, Patna in connection with Complaint Case No. 1091 (C) of 2015 subject to the following conditions: (i) One of the bailers shall be the own/close family members of the petitioner.
(ii) In case of framing of charge, the petitioner shall appear in person on each and every date fixed in the Court below. In case of default in doing so on two consecutive occasions without any cogent/satisfactory reason, the Trial Court shall have liberty to cancel the bail bond of the petitioner and secure her arrest in accordance with law.
