Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner's claim for regularization is based on on his seniority in the panel prepared for the purpose of regularization in the year 2011. Recording this stand of the State in the writ proceedings arising out of C.W.J.C. No. 17596 of 2016, writ application was disposed of.

The contempt petition has been filed alleging

Patna High Court MJC No.3421 of 2019(3) dt.12-07-2023 2/2 that steps are not being taken as per their stand recorded in the writ order.

The show cause filed on behalf of the opposite party specifically states that the petitioner was placed at Serial No. 95 in the panel of 2011 in the unreserved category. In the petitioner's category, persons up to Serial No. 67 have been appointed as the last candidate from the panel of 2011. 5.

In view of such uncontroverted stand in the show cause, this court is of the view that no case for contempt is made out.

Contempt petition is dismissed.
