JUSTICE SANJAY PRIYA ORAL ORDER 16-05-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks bail in Sadar P.S. Case No. 10 of 2017 instituted for the offence under Section(s) 302 and 201 of the Indian Penal Code.

It is alleged that on 05.01.2017 at 12 noon the informant got an information that a dead body is lying near the railway line and after that she identified the dead body of her husband. It is further alleged that unknown person had killed her husband.

The Case Diary has been received. The learned APP submits that during course of investigation it has come that the

Patna High Court Cr.Misc. No.19861 of 2017 (3) dt.16-05-2017 2/2 informant has illicit relationship with one Shishir Kumar. The name of this petitioner has been disclosed in the confessional statement of Shishir Kumar. The Sessions Judge has also mentioned in the impugned order the police has recorded the confessional statement of Shishir Kumar who has described the whole episode and has disclosed the name of this petitioner. He has also stated in confessional statement that he had illicit relationship with the informant. The petitioner is in custody since 17.01.2012. It is mentioned in para 3 of the bail petition that he has no criminal antecedent.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in connection with Sadar P.S. Case No. 10 of 2017 subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) Prakash/- U T
