This application for anticipatory bail arises out of Minapur P.S. Case N0. 172 of 2019, disclosing offences under Sections 498A, 304B/34 of the Indian Penal Code. The petitioner is wife of the elder brother of the husband of the deceased. All family members of the husband of the deceased including the husband himself have been implicated in the First Information Report. Learned counsel for the petitioner has submitted that there is no specific allegation against the petitioner of having ever made any demand of dowry nor there is any material to directly connect her with the offence alleged. Considering the above submission, this application is allowed.
Let the petitioner above named in the event of her
Patna High Court CR. MISC. No.56376 of 2019(2) dt.05-09-2019 2/2 arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in Minapur P.S. Case No. 172 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present herself before the Police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, her bail bonds shall be liable to be cancelled.
