The Opposite Party No. 02 had earlier appeared through Rakesh Kumar Singh, Advocate but now he is being represented by Harshwardhan Sahay, Advocate who has chosen not to appear.

Learned counsel for the petitioner submits that the matter has been settled between the parties in Civil Suit and the Opposite Party No. 02 has been given a cheque of Rs. 4 lacs vide cheque dated 22.11.2018 and after getting the money, it seems that the Opposite Party No. 02 is not taking interest in the matter.

In view of the settlement between the parties, this

Patna High Court CR. MISC. No.45230 of 2015(10) dt.19-04-2023 2/2 application is allowed.

Accordingly, the order dated 09.07.2015 passed by learned Judicial Magistrate, 1st Class, Patna in Complaint Case No. 29054(c) of 2014, is hereby quashed.
