2. The petitioners seeks bail in connection with Jokihat P.S. Case No. 167 of 2025 registered for the offences punishable under Sections 111 of BNS and section 30(a) of the Bihar Prohibition& Excise Amendment Act.
3. The recovery is of 2531.52 liters foreign liquor from the vehicles.
4. Learned counsel for the petitioners submits that petitioners are innocent and he is in custody since 26.05.2025. The petitioners have claimed clean antecedent.
5. The learned APP for the State opposes the prayer
Patna High Court CR. MISC. No.65957 of 2025(2) dt.24-09-2025 2/3 for bail of the petitioners.
6. Considering the fact and circumstances of the case and submissions of the parties, let the above named petitioners, be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand)with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/ successor court in connection with Jokihat P.S. Case No. 167 of 2025.
7. This is also subject to the condition that the petitioners shall deposit an amount of Rs. 20,000/- each petitioner in Ramakrishna Mission Sevashrama, Swami Vivekananda Path, Bela, Muzaffarpur, Bihar and produced the receipt of the same before the court below. The bail bonds of the petitioners shall be accepted after verifying the genuineness of the receipt produced by the petitioners.
8. As a condition of this order, the petitioners after being released on bail are directed to mark their attendance at Belsar Police Station on first and third Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioners.
9. As the petitioners claims to have clean antecedent, the court below, before accepting the bail bonds of the
Patna High Court CR. MISC. No.65957 of 2025(2) dt.24-09-2025 3/3 petitioners is directed to verify the antecedent of the petitioners. If the petitioners are found to be involved in any other cases then the bail bonds of the petitioners shall not be accepted. (Sandeep Kumar, J) N.K/- U T
