The petitioner seeks bail in Baniyapur P.S. Case No. 226/2016, registered for the offences punishable under Sections 413 and 414 of the Indian Penal Code.
The petitioner was apprehended with the stolen motorcycle.
Learned counsel for the petitioner submits that the petitioner took the motorcycle from his villager. He was not knowing the fact that the motorcycle was stolen one, but the petitioner did not disclose the name of the person from whom he borrowed the motorcycle. The stolen motorcycle was recovered from the possession of the petitioner for that the petitioner is in jail
Patna High Court Cr.Misc. No.22293 of 2017 (3) dt.23-06-2017 since 18.08.2016. The petitioner has already remained in jail for ten months and he has got no criminal antecedent. Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional District & Sessions Judge 9th, Saran, Chapra in connection with Baniyapur P.S. Case No. 226/2016.
