Mr. Umesh Lal Verma ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-09-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Nasriganj P.S. Case no. 126 of 2019, registered under Section 302/34 of the Indian Penal Code. The accusation is that marriage of Rubi Devi, sister of the informant, was performed with the Sunil Paswan, son of Ramjanam Ram, resident of Pipardih, P.S. Nasriganj, Rohtas, but there was no issue to her due to that reasons, she was being tortured by her husband and other in-laws and they also have threatening to do another marriage. On 13.06.2019, informant received message by his sister that she will be killed by the accused persons. On 15.06.2019, informant received information regarding killing of his sister. Thereafter, informant along with others went at the matrimonial house of his sister

Patna High Court CR. MISC. No.56739 of 2019(2) dt.06-09-2019 2/2 and saw his sister was lying dead.

Learned counsel for the petitioners submits that petitioners are mother-in-law and brother-in-law of the deceased. Further submission is that, in fact, deceased along with her husband went to attend marriage ceremony, where she became ill and she was rushed for treatment, but died in the way. Thereafter, information was given to the informant, but with ulterior motive, the informant lodged the present case. Further submission is that in Postmortem report no any external injury was found on the person of deceased. The petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.II, Bikramganj, Rohtas in connection with Nasriganj P.S. Case No. 126 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
