2. The petitioner is in custody since 07.08.2014 in connection with Kadam Kuan P.S. Case No. 359 of 2014 for the offences alleged under Section 25(1-b)1/26/35 of the Arms Act.
3. It is submitted that the petitioner has been falsely implicated and in any event no overt act has been attributed to the petitioner except recovery of two live cartridges from his possession when he was riding a motorcycle along with two other co-accused from whose possession also one country made pistol and two live cartridges have been recovered.
4. Having regard to the nature of accusation,
Patna High Court Cr.Misc. No.44324 of 2014 (2) dt.03-03-2015 recovery of the live cartridges from the conscious possession of the petitioner as well as criminal antecedent, this Court is not inclined to grant privilege of bail to the petitioner at this stage. The bail petition stands dismissed.
