The petitioner seeks bail in Mohammadpur P.S. Case No. 32 of 2016 registered under Section 414 of the Indian Penal Code.

Co-accused Jitendra Kumar Yadav was apprehended with stolen motorcycle. The name of the petitioner was surfaced in the case on the basis of the confessional statement of Jitendra Kumar Yadav.

It is submitted by learned counsel for the petitioner that nothing incriminating article has been recovered from the conscious physical possession of the petitioner. The petitioner is not named in the F.I.R. and he was not apprehended on the spot.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Mohammadpur P.S. Case No. 32 of 2016.
