2. The petitioners seek bail in Nardiganj P.S. Case No. 191 of 2024 registered for the offence punishable under Section379 of the Indian Penal Code.

3. Allegedly, Luna motorcycle of the informant, parked near his residence, was burgled by some unknown persons.

4. It has been submitted on behalf of the petitioners that the petitioner No. 2 has got criminal antecedent of one case whereas the petitioner No. 1 is a person of clean antecedent. It has further been submitted that the petitioners are not named in

Patna High Court CR. MISC. No.64732 of 2024(2) dt.18-09-2024 2/2 the FIR. Nothing incriminating was recovered from possession of the petitioners. The stolen motorcycle was recovered from the campus of police station and not from possession of the petitioners. The petitioners are languishing in judicial custody since 29-06-2024.

5. Learned APP has opposed the prayer for bail.

Considering the aforesaid facts and circumstances, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Smt. Siya Suruti, learned Judicial Magistrate-Ist Class, Nawada in connection with Nardiganj P.S. Case No. 191 of 2024 with condition that the petitioner shall cooperate with the trial of the case and make himself available as and when required by the court.
