Petitioner seeks regular bail in connection with Siwan Town P.S. Case No.52 of 2017 registered for the alleged offences under Sections 413 and 34 of the Indian Penal Code. As per the prosecution case, the petitioner and two other accused persons were apprehended with a stolen motorcycle two keys of the motorcycle was recovered from the possession of the petitioner.
It has been submitted by learned counsel for the petitioner that the key of the motorcycle, which was recovered from his possession, is not of the stolen motorcycle, rather it is of some other motorcycle. He has been falsely implicated in this
Patna High Court Cr.Misc. No.28946 of 2017 (02) dt.03-07-2017 2/2 case at the instance of some local influential persons. He has been languishing in jail custody since 28.01.2017. In the facts and circumstances of the case, the petitioner above named is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Siwan Town P.S. Case No.52 of 2017.
