NILU AGRAWAL ORAL ORDER 23-06-2017 Heard learned counsel for the petitioner and learned APP for the State.
Petitioner is languishing in custody since 28.12.2016 in connection with Barauni P.S. Case No. 320/16 for offences punishable under Sections 363, 364, 302, 201/34 of the Indian Penal Code.
The prosecution case, as lodged by the informant, is that her four year old son was playing under a banyan tree and disappeared.
It has been submitted by the learned counsel for the petitioner that he is innocent, not named in the First Information Report and his name transpired during course of investigation along with two other accused persons, who were said
Patna High Court Cr.Misc. No.23453 of 2017 (3) dt.23-06-2017 2/3 to be seen carrying the dead body of the son of the informant by the Dewar of the informant Amarjeet Singh, who, however, had retracted from his statement. The said co-accused Bhola Rai accompanying the petitioner, has since been granted the privilege of pre-arrest bail in Cr. Misc. No. 16776 of 2017 on 01.05.2017. He submits that the petitioner has been made accused only on the basis of suspicion.
However, learned APP for the State opposes the prayer for bail stating therein that the witnesses have supported the prosecution case.
Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Barauni P.S. Case No. 320/16 with following conditions : i. One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court ;
ii. The petitioner will not induce any witness or tamper with the evidence ; and iii. The petitioner shall cooperate in the investigation
Patna High Court Cr.Misc. No.23453 of 2017 (3) dt.23-06-2017 3/3 of the case and make himself available as and when required by the police and if during course of investigation any serious incriminating material comes against the petitioner, the prosecution is free to move for cancellation of his bail bond.
