The petitioner seeks bail in Waris Nagar (Mathurapur O.P.) P.S. Case No. 289 of 2016 registered for the offences punishable under Section 273 of the Indian Penal Code and under Sections 30(K), 37(K), 37(G) 38/41 of the Bihar Liquor Prohibition and Excise Act, 2016.

The petitioner along with his son were arrested and from their possession 1097 bottles of whiskey of 180 ml 240 bottles of whiskey of 375 ml and 24 bottles of whiskey of 750 ml were recovered.

Learned counsel for the petitioner submits that Sunil Rai son of the petitioner has already been enlarged on bail vide order dated 13.04.2017 passed in Cr. Misc. No. 10909 of 2017.

Patna High Court Cr.Misc. No.29888 of 2017 (3) dt.12-07-2017 2/2 Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Learned Sub-Divisional Judicial Magistrate, Samastipur in Waris Nagar (Mathurapur O.P.) P.S. Case No. 289 of 2016.
