The petitioners are apprehending their arrest in connection with Shankarpur P.S.Case No.76 of 2019 dated 14.5.2019 registered for offences punishable under Sections 365 and 120(B) of the Indian Penal Code.
As per FIR petitioners and other accused persons kidnapped the minor son of the informant. It further appears from the impugned order that the statement of the son has been recorded who has also supported the allegation and submitted that he was forced to marry with the daughter of the petitioner no.1.
Submission of the learned counsel for the petitioner is
Patna High Court CR. MISC. No.56315 of 2019(3) dt.16-11-2019 2/2 that there is general alleviation against all the accused persons and as a matter of fact there is dispute with respect to marriage and as such the present case has been lodged. Heard learned A.P.P. , who has opposed the prayer for bail on the ground that the witnesses have also supported the case apart from the statement of the victim boy.. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court.
With the aforesaid direction, this application is dismissed.
