JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Hathauri P.S. Case No. 241 of 2018, registered for the offences punishable under Sections 147, 148, 149, 447, 323, 302 of the Indian Penal Code.

As per FIR allegation against the petitioner is that petitioner along with other accused assaulted the brother of the informant by means of Farsa etc. later on brother of the informant succumbed to injury.

Submission of the learned counsel for the petitioner is that he was not present at that time at the place of occurrence. Heard learned A.P.P. also who opposed the prayer for bail submitted that from perusal of the impugned order it appears that various paragraphs witnesses have also supported the allegation of assault against the petitioner.

No.57343 of 2019(2) dt.11-09-2019 2/2 Having heard both sides, in view of the allegation as discussed above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned Court below and make prayer for regular bail which shall be considered on it own merits without being prejudiced by this order.
