The Petitioners apprehend their arrest in Bodh Gaya P.S. Case No. 264 of 2019 registered for the offence punishable under Sections 302, 201/34 of the Indian Penal Code. Allegation against the petitioners is of committing murder.

It has been submitted on behalf of the petitioners that they are innocent and have been falsely implicated in this case. FIR is against unknown. Petitioners have got no criminal antecedent.

Considering the fact that co-accused person Bindeshwar Yadav has admitted in his confession that Pradeep

No.56997 of 2019(3) dt.27-11-2019 2/2 Kumar Yadav (petitioner), his son and Goralal Kumar Yadav (petitioner) and his nephew have killed the deceased and similar confession was made by co-accused Sukhdeo Singh and Rekha Devi wife of deceased, as such, I am not inclined to enlarge the petitioners on anticipatory bail.

Hence, the prayer for anticipatory bail of the petitioners is hereby rejected.

However, it is observed that if petitioners surrender before the court below and prays for regular bail, their application for regular bail will be considered and disposed of preferably on the same day, without being prejudiced by this order.
