1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Sherghati (Gaya) Complaint Case No. 689 of 2022, disclosing offences under Sections 498-A/34 of the Indian Penal Code.
3. As per the allegation made in the complaint, the marriage of the complainant was solemnized with the co-accused Sudhanshu Kumar on 29.06.2022. It has been alleged that after some time, the accused persons, including the
Patna High Court CR. MISC. No.74949 of 2023(4) dt.21-03-2024 2/3 petitioner, started demanding Scorpio vehicle as dowry and due to non-fulfillment of the demand, the complainant was tortured physically as well as mentally.
4. Learned Counsel for the petitioner submits that the petitioner is father-in-law of the complainant and has not committed any offence in the manner alleged. He further submits that entire family members have been made accused on the basis of general and omnibus allegation.
5. Regards being had to the submissions made on behalf of the parties and taking into consideration the fact that the petitioner is father-in-law of the informant and entire family members have been made accused, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner , above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati (Gaya), in connection with Sherghati (Gaya) Police Station Case No. 689 of 2022,
