Petitioner is languishing in custody since 20.01.2017 in connection with Chiksaura P.S. Case No. 07/2017 for offences punishable under Sections 364, 120-B/34 of the Indian Penal Code.
The prosecution case, as lodged by the informant, is that his son Sanjeev Kumar works in Patna and had come to the village and while returning he became traceless. It is further alleged that the informant's son had illicit relations with one Priyanka Devi, who was a married woman and daughter of Manoj Paswan. It is also alleged that all the family members of Manoj
Patna High Court Cr.Misc. No.28769 of 2017 (3) dt.03-08-2017 2/2 Paswan including the petitioner, who is wife of Manoj Paswan, have killed the informant's son and disposed of his dead body. It has been submitted by the learned counsel for the petitioner that she is innocent, bears no criminal history and general and omnibus allegation has been levelled against her. In fact, the husband of Priyanka Devi has not alleged of any overt act committed by the petitioner and just because she is wife of said Manoj Paswan she has been falsely implicated. However, learned APP for the State opposes the prayer for bail stating therein that petitioner along with all the family members has killed the informant's son and disposed of the dead body.
Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Hilsa, Nalanda, in connection with Chiksaura P.S. Case No. 07/2017.
