JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-06-2017 The petitioner seeks regular bail in connection with Amarpur P.S. Case No. 240/15, registered for offences punishable under Section 341, 323, 504, 386, 307/34 of the Indian Penal Code, Section 3 and 4 of Explosive Substance Act and Section 27 of Arms Act.

Allegation against the petitioner that he along with other co-accused persons entered into the house of the informant and assaulted his nephew by means of fists and slaps and also exploded bomb.

It has been submitted on behalf of the petitioner that only general and omnibus allegation of assault to the nephew of informant and exploding bomb has been levelled against the petitioner and other accused persons and no specific allegation has

Petitioner has clean antecedent and has remained in custody for more than two months and other coaccused of this case has already been granted bail by this court vide order17.05.2017 passed in Criminal Miscellaneous No. 23539 of 2017 and vide order dated 15.02.2017 passed in Criminal Miscellaneous No. 3945 of 2017.

Having heard both sides, in view of the fact that only general and omnibus allegation has been levelled against the petitioner and petitioner has no criminal antecedent and has remained in custody for more than two months and other coaccused persons have already been granted bail by this court, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five) with two sureties of the like amount each to the satisfaction of learned CJM, Banka, in connection with Amarpur P.S. Case No. 240 of 2015, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
