Mr. Government Pleader 05 ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJIV ROY ORAL ORDER 03-11-2025 Heard Mr. Shashwat, learned counsel for the petitioners duly assisted by Mr. Amritesh Kumar Singh and learned counsel representing the State.
2. The present petition has been preferred for the grant of following relief(s):
"(i) for issuance of an appropriate writ/writs, order/orders or direction/directions
Patna High Court CWJC No.15873 of 2025(2) dt.03-11-2025 2/3 commanding the respondent authorities to consider and allot homestead land to the petitioners in accordance with the provisions of the Bihar Privileged Persons Homestead Tenancy Act, 1947 and the Rules, 1948 framed thereunder, as specifically mandated under Resolution No. 06 dated 17.06.2015 issued by the Department of Revenue and Land Reforms, Government of Bihar.
(ii) for issuance of an appropriate writ/writs, order/orders or direction/directions directing the respondent authorities to ensure the construction/provision of residential houses for the petitioners under the appropriate government housing schemes, in a time-bound manner.
(iii) for grant of any other relief or reliefs for which the petitioners may be found entitled in the facts and circumstances of the present case, in the interest of justice."
3. At the outset, learned State counsel submits that the claim has been made by the petitioners but there is no document
Patna High Court CWJC No.15873 of 2025(2) dt.03-11-2025 3/3 on record to show that individually they have approached the Collector, Bhagalpur for the redressal of the grievance.
4. This Court has also gone through the different annexures and the contention put forward by the learned State counsel seems justified. In that background, learned counsel for the petitioners submit that they shall be approaching before the Collector, Bhagalpur (respondent no.5) with all the supporting documents in next four weeks.
5. Learned State counsel submits that if such petition is preferred, the same shall be taken to its logical conclusion.
6. In that background, the writ petition stands disposed of allowing the petitioner to approach alongwith all the supporting documents to claim their respective cases before the Collector, Bhagalpur (respondent no.5) who shall be taking up the matter, seeking report from the revenue authorities and it is expected that the same shall be taken to its logical conclusion preferably by 30.06.2026.
