====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 30-09-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Mali P.S. Case No. 02 of 2019 for the offenses under Sections 399, 402, 414 of the Indian Penal Code.

Learned counsel for the petitioner submits that the allegation against the petitioner in the instant case is that he assembled with other persons for commission of crime (dacoity). One gold ring and Rs. 8,000/- were seized from conscious possession of the petitioner. The petitioner is in custody since 24.01.2019. Learned counsel for the petitioner would submit that the co-accused has been granted bail in Cr.Misc. No. 35100 of 2019 vide order dated 28.05.2019.

Patna High Court CR. MISC. No.58623 of 2019(2) dt.30-09-2019 2/2 Considering the facts and circumstances of the case, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad, in connection with Mali P.S. Case No. 02 of 2019.
