JUSTICE SATYAVRAT VERMA ORAL ORDER 13-05-2022 Heard learned counsel for the petitioners and learned APP for the State through video conferencing. The petitioners seek bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 332, 333, 307, 337, 338, 353, 504, 506, 224, 225, 427 of the Indian Penal Code.

The learned counsel for the petitioners submits that the petitioners are in custody since 20.09.2021, they are persons with clean antecedent and charge-sheet has been submitted in the case.

The learned counsel for the petitioners submits that the informant alleges that while the police force after arresting an absconder accused of Gogri P. S. Case No.49 of 2019 were coming out of the village when the accused persons including the petitioners formed an unlawful assembly and surrounded the

No.72492 of 2021(2) dt.13-05-2022 2/2 raiding party team and started assaulting with lathi, danda, brick etc. causing injury to the police force on head, hand etc. The learned counsel for the petitioners submits that from perusal of the allegation as alleged in the F.I.R., it would manifest that the allegations are general and omnibus in nature and no specific allegation has been alleged against the petitioners.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioners are in custody, they are persons with clean antecedent and chargesheet has been submitted in the case, the petitioners, abovenamed, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Gogri P. S. Case No.316 of 2020.

The application stands allowed.
