JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 13-04-2023 Heard learned counsel for the petitioner and the State. The petitioner is seeking a direction to the respondents to consider her representation dated 01.06.2022 addressed to the Director-in-Chief, Health Department, Bihar, Patna to transfer her from A.N.M.C.H., Gaya to Vardman Institute of Medical Institute, Pawapuri (Nalanda). Learned counsel for the petitioner submits that the petitioner has been continuously working at the present place since the year 2006. According to her, the transfer policy of the Government envisages transfer of a Grade Mid Wife (Nurse) after completion of a period of three years. It is her submission that her father is 80 years old and suffering from severe ailments, further there is no one in the family to look after him.

Patna High Court CWJC No.16073 of 2022(2) dt.13-04-2023 2/2 Learned counsel for the State submits that so far as the prayer of the petitioner to consider her representation is concerned, there may not be any opposition to that extent. In the circumstances, this Court directs the Directorin-Chief, Health Services Bihar, Patna (respondent no. 2) to consider the representation of the petitioner keeping in view the transfer policy and the guidelines as also the precedence and take an appropriate decision thereon within a period of three months from the date of receipt/production of a copy of this order.
