The petitioners seek bail in Dumariyaghat P.S. Case No. 147 of 2021, registered for the offence punishable under Sections 307, 323 and other allied sections of the Indian Penal Code.

As per prosecution case, Kumod Ranjan Pandey petitioner no. 1 assaulted the son of informant by iron rod on his head and left hand as a result of which he sustained fracture injury. Prakash Pandey petitioner no. 2 and co-accused Shailesh Pandey assaulted daughter-in-law of the informant by lathi causing injury on her hand.

It is submitted on behalf of the petitioners that present

Patna High Court CR. MISC. No.72160 of 2021(2) dt.10-03-2022 2/2 case is counter blast of Dumariyaghat PS Case No. 146 of 2021 which was instituted by the petitioner's side on 15.07.2021 whereas the present case was lodged on 28.07.2021 in retaliation to save their skin from the said case. There is no injury report of Seema Devi, daughter-in-law of informant on the record. Section 144 Cr.P.C was pending between them. Petitioners are in custody since 22.10.2021.

Considering the facts and circumstances and the fact that there is case and counter case, the petitioners above-named, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned 1st Additional Chief Judicial Magistrate, East Champaran at Motihari in connection with Dumariyaghat P.S.
