The petitioner seeks bail in a case registered under Sections 395, 397 of the Indian Penal Code.

Allegation is that 5-6 unknown miscreants entered into the Bank and locked the main gate and they started threatening to customers and Bank employees with the help of arms and the miscreants looted cash of Rs.4,46,027/-, which was kept in the almirah and they also looted Rs.6,15,000/- from the strong room.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 26.09.2018. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not

Patna High Court CR. MISC. No.57286 of 2019(2) dt.11-09-2019 2/2 named in the F.I.R. His name has come on confessional statement of co-accused. There is no recovery of any incriminating article from the possession of the petitioner. The petitioner has not been put on T.I.P. Other co-accused has been granted bail vide Cr.Misc.No.26254 of 2019.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua P.S. case No.110 of 2018.
