JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-04-2015 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners are accused in connection with Bakhri P.S. Case No. 91 of 2014 registered under Sections 363, 366(A)/34 of the Indian Penal Code.

The accusation is that petitioners along with Sajjan Kumar Yadav and one unknown kidnapped Preeti Kumari, minor daughter of the informant aged about 15 years on 16.03.2014 at 11.00 pm. at the point of pistol.

Learned counsel appearing on behalf of the petitioners submits that petitioners have been named in the F.I.R. mere on suspicion. In course of investigation, the Police got recorded the

P.C. in which she herself stated about her moving for Kisanganj by train and denied the allegation of kidnapping, which would appear from the Annexure-2. It is also submitted that petitioner has no criminal antecedent.

Considering the aforesaid submissions, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the C.J.M., Begusarai in connection with Bakhri P.S. Case No. 91 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
