The petitioner seeks bail in connection with Jagdishpur P.S. Case No. 09 of 2017 registered under Section 379 of the Indian Penal Code.

The accusation is of theft of tractor of the informant with trailer by unknown thief.

Learned counsel appearing on behalf of the petitioner submits that petitioner is not named in the F.I.R. and his name has been disclosed in the confessional statement of co-accused Karnal Singh as his associates in this case and then the petitioner was apprehended by the police. Tractor along with trailer was

Patna High Court Cr.Misc. No.28104 of 2017 (2) dt.23-06-2017 2/2 recovered from village Rampur Kharhara. Further submission is that petitioner is also made accused in Jagdishpur P.S. Case No. 10 of 2017 registered under Section 379 of the I.P.C. Petitioner is in custody since 28.03.2017.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhagalpur in connection with Jagdishpur P.S. Case No. 09 of 2017.
