JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-47(a)/50 of the Bihar Excise Amendment Act, 2016. In huge quantity, pouches of country-made liquor were recovered from a vehicle and so far as petitioner is concerned; it is alleged that he along with one co-accused had kept vigil over the above-said vehicle prior to the alleged occurrence and on the basis of aforesaid circumstance, the petitioner has been made accused in this case. Moreover, the petitioner does not have any criminal antecedent and is languishing in jail custody since 25-07-2016. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs.
