JUSTICE SANJAY PRIYA ORAL ORDER 21-06-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Digha P.S. Case No. 90 of 2013 corresponding to Sessions Trial No. 1421 of 2013 instituted for the offence under Sections-399, 402 of the Indian Penal Code and 25(i-b)a/26/35 of the Arms Act.

It has been submitted that the petitioner is in custody since 27-04-2013.

The report regarding the stage of the trial, as called for by this court, has been received. From perusal of the report, it appears that charge has been framed in this case but no witness has been examined. There is allegation against the petitioner that one loaded country-made pistol and three live cartridges were recovered from his possession. The petitioner has got criminal

No.19822 of 2017 (4) dt.21-06-2017 2/2 antecedent also and about 13 cases are pending against him but taking into account the period, spent by the petitioner in custody and the fact that not a single prosecution witness has been examined in the court below, the prayer for bail of the petitioner is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Digha P.S. Case No. 90 of 2013 corresponding to Sessions Trial No. 1421 of 2013 to the satisfaction of learned Additional Sessions Judge-IV, Patna subject to condition that both the bailors should be close relatives of the petitioner. The further condition is that the petitioner will appear in the court below in person, on each and every date and any default without any valid ground, will entail the cancellation of bail of the petitioner.
