The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 30(a), 32(i)(ii), 41(i) and (ii) of the Bihar Prohibition and Excise Act, 2022.

It is a case of recovery of illicit liquor from a Scorpio bearing registration no.BR-11-PC-5964, which belongs to this petitioner. Petitioner is the constable in the Department of Police posted in the Patna District.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that petitioner is ready to deposit Rs.15,000/- in favour of the District Legal Services Authority, Khagaria.

Learned APP appearing for the State opposed the anticipatory bail and submitted that the petitioner is a registered owner of the vehicle in question, seized on the spot. Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge-Ist Excise, Khagaria in connection with Choutham P.S. Case No. 223 of 2022 arising out of G.R. No.481 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C with further condition that at the time of furnishing bail bond, the petitioner shall produce receipt of Rs.15,000/ meant to be paid to District Legal Services Authority, Khagaria.
