JUSTICE ARVIND SRIVASTAVA ORAL ORDER 20-04-2023 Heard learned counsel for the petitioner, learned counsel for the B.S.F.C. and learned A.P.P. for the State. The petitioner apprehends his arrest in connection with Digha P.S. Case No.343 of 2022 registered under Sections 406, 409, 420, 467, 468, 471 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. It is submitted that similarly situated co-accused person has already been granted anticipatory bail by a coordinate Bench of this Court vide order dated 10.04.2023 passed in Cr.Misc.No.5372 of 2023.

Patna High Court CR. MISC. No.59287 of 2022(6) dt.20-04-2023 2/2 for the B.S.F.C. opposed the prayer for bail but has not denied the fact that in the report, responsibility in the entire episode is also levelled against the Transporting Agent. Having considered the fact that similarly situated coaccused person has already been granted anticipatory bail by a coordinate Bench of this Court, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. XIII, Patna in connection with Digha P.S. Case No.343 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
