JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 15-10-1015 The petitioner apprehends his arrest in relation to Saraiya P.S. Case No. 49 of 2015 registered under Sections 147, 148, 149, 452, 380, 435, 427 and 307 of the Indian Penal Code.

Learned counsel for the petitioner draws attention of this court to the fact that the young boy of the petitioner was found missing for which petitioner had lodged First Information Report. Three days later, the dead body of son of the petitioner was found near the village of the informant for which another First Information Report was lodged. When people came to know of this there was a riot like situation in which the houses of a particular community was looted on the allegation that they were responsible in the

Patna High Court Cr.Misc. No.47435 of 2015 (2) dt.15-10-2015 death of son of the petitioner. It is in one of those cases lodged by those villagers that petitioner now apprehends.

Be that as it may, in the event of his arrest/surrender before the court below within four weeks, let the petitioner, namely, Kamal Sahani @ Kamal Sahni, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur, in connection with Saraiya P.S. Case No. 49 of 2015, subject to conditions laid down under Section 438 (2) of the Code of Criminal Procedure.
