JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 24-03-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Ahiyapur P.S. Case No. 392 of 2022, registered for the offences punishable under Section 328, 302/34 of the Indian Penal Code.

As per allegation, the informant got a telephonic information that the dead body of his father was lying in the house of co-accused Rudal Sahani. It has mentioned in the FIR that father of the informant used to go to the house of coaccused Rudal Sahani and used to consume liquors with him. The informant expressed his suspicion that the petitioner, who is wife of Rudal Sahani, along with his family members

The learned counsel for the petitioner has submitted that except suspicion, there is nothing against the petitioner. She has falsely been implicated merely because she is wife of coaccused Rudal Sahani. He has submitted further that no mark or sign of injury was found on the dead body, as per post-mortem report. The petitioner is a lady of clean antecedent and she is under custody since 15.05.2022.

On the other hand, the learned APP for the State has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 392 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for
